Any $150,000 construction contract entered into by the city with the assistance of the FTA contains provisions requiring third parties to supply goods manufactured or manufactured in the United States for use in the construction project that the recipient acquires, unless the FTA has granted an approved waiver under these rules. FTA points out that its buy america rules are complex and differ from the provisions of the Buy American Act in subsections FAR 25.1 and 25.2. The property that the Contractor acquires to carry out its construction activities for the consignee, such as tools, machinery and other equipment or facilities, does not fall within the requirements of the FTA`s Buy America, unless the Beneficiary intends to take possession of that property at the end of the project. . . .
